Instructions on the procedures of the issuance of the first temporary stay permit to aliens

 

First step – competent diplomatic mission/consular post of the Republic of Croatia

The application for the issuance of his/her first temporary stay permit (Form 1a *1) an alien shall submit in person at a competent diplomatic mission or a consular office of the Republic of Croatia

An alien may also submit such an application at a competent police administration or a police station in cases where:
  • there exist serious humanitarian reasons for
  • the family reunion with Croatian national or asylum seeker is being requested;
  • the application is lodged by a scholarship student in the framework of the program approved by a ministry responsible
  • for educational and scientific affairs;
  • the purpose is the work of an alien;
  • an alien arrives to the country for the purpose of conducting a scientific investigation.

If the application for temporary stay is submitted for the purposes of work, an application for a temporary stay on the base of a work permit may be filed by an employer at a competent police administration or police station and enclosed with the work permit application.

The following documents should be enclosed with the application for the first temporary stay permit:

  • 2 colour photographs, 35 x 45 mm;
  • copy of a valid travel document;
  • proof of ensured dwelling;
  • proof of ensured health insurance;
  • proof of ensured means of subsistence in compliance with the Regulation on the method of calculation and amount of means of subsistence for aliens in the Republic of Croatia („Official Gazette“ No 88/09);
  • proof of the reasons for temporary stay;
  • clearance certificate issued by the state of an alien's nationality, or by the state in which he/she has permanent residence, dated not more than 6 months prior to its issuance (only enclosed with the first temporary stay application);
  • consular fees in compliance with the Tariff No 78a of the Administrative Fees Act, if the application has been filed at a diplomatic mission or a consular post of the Republic of Croatia;
  • government stamp of 20.00 HRK if the application has been filed in the Republic of Croatia. 

The documents that are being enclosed with the application must be original documents or certified copies. Documents written in a foreign language must be filed together with the certified translation into the Croatian language and certified in line with specific provisions. The documents should be dated not more than 6 months prior to their delivery.

Second step – competent diplomatic mission/consular post of the Republic of Croatia

The Application for the issuance of the first temporary stay permit should be filed at a police administration or a police station according to the intended place of stay of the alien concerned, in the Republic of Croatia.

Upon the completion of the procedure, the respective police administration or a police station shall inform the respective diplomatic mission or the consular post of the completion of the procedure.

The respective diplomatic mission or the consular post shall then inform the concerned party of the decision on the application.

Third step – competent diplomatic mission/consular post of the Republic of Croatia

If the application has been positively decided, the alien concerned shall be issued a temporary stay permit in a form of a sticker in his/her travel document.

Where the application has been submitted at a police administration or a police station, the alien concerned shall pay the amount of 500.00 HRK and 27.76 for the mentioned sticker. This shall be paid by means of 2 separate payment slips to a drawing account communicated at a competent police administration or a police station.

Fourth step – competent police administration/police station

If the application has been submitted at a diplomatic mission or a consular office, the alien concerned shall, within 30 days from the approval of his/her temporary stay, register his/her address at a police administration or a police station. In case he/she fails to do so, the temporary stay permit of the alien concerned shall cease to have effect.

An alien shall report his/her place of stay to a competent police administration or a police station within 3 days after the day of his/her entry to the Republic of Croatia.

The approval for the first temporary stay, that is, the renewal of the temporary stay permit shall be valid for the period of up to 1 year. The application for the temporary stay permit renewal shall be submitted to a police administration or a police station not later than 30 days before the existing temporary stay permit expires. In case the alien concerned fails to apply for the temporary stay permit extension, he/she shall be charged a fine (Aliens Act, Article 203(1)(2)”).
